If you’ve ever tossed a bag of Deep River potato chips into your cart thinking they were non-GMO, you might be entitled to a chunk of a $4 million payout.
That’s right, crisp lovers across the U.S. can now cash in on a class action settlement just by filling out a simple online form. But you’ve got to act fast: the deadline to submit your claim is July 28, 2025.
The lawsuit centers on Old Lyme Gourmet, the company behind Deep River Snacks, which marketed its chips as “non-GMO” despite allegedly using genetically modified ingredients. Customers say they were misled by the “non-GMO ingredients” label, which gave the impression the chips had been certified by a third-party organization like the Non-GMO Project. Old Lyme has denied any wrongdoing but agreed to settle the case for $4 million.
If you bought any Deep River chips with a “non-GMO” label between February 2, 2017, and December 6, 2024, you’re eligible to file a claim. And yes, that includes all flavors, so whether you were grabbing Mesquite BBQ, Original Sea Salt, or Zesty Jalapeño, you can get in on the deal.
Now, let’s talk money. Shoppers with a receipt can claim $5 for the first product and 50 cents for every additional one, with no cap on the number of items, meaning if you’ve got a grocery drawer full of old receipts, you might walk away with a nice haul. Don’t have proof of purchase? You’re still eligible, just with a limit: you can claim for up to 10 items, for a total of $10.
To get your share, just fill out the online form and upload any receipts or order confirmations you’ve got. It’s quick, straightforward, and doesn’t cost a dime. But again, make sure to file before July 28, or you’ll miss the deadline and leave money on the table.
And that’s not the only food-related settlement making headlines right now. Soda brand Poppi, best known as a trendy Coca-Cola competitor, has agreed to an $8.9 million payout over its own false advertising allegations. Consumers who bought Poppi between January 23, 2020, and July 18, 2025, can also file claims, with a deadline set for September 26.
Back to the chips: this isn’t about coupon codes or loyalty points. This is cold, hard cash being returned to customers who thought they were making a healthier, non-GMO choice. Whether you bought one bag or twenty, this is your chance to get something back, just for snacking.
So if Deep River chips have ever been part of your grocery haul, now’s the time to click over to the settlement website and make it official. You’ve earned it, one crunchy bite at a time.
